Taxi Medallions, Permits and Robotaxis: Who Is Allowed to Run a Driverless Taxi (NYC, California, Texas)

General information, not tax or legal advice. Talk to your tax preparer or attorney about your situation.

Running a driverless taxi takes permits, not just a car. California requires a DMV deployment permit and CPUC authority to charge fares, Texas requires a TxDMV authorization, and New York City's TLC taxicab rules, as written today, call for a TLC-licensed driver. Individuals can't buy or operate a Cybercab as of October 2026.

Where things stand (October 2026): individuals can't buy or operate a Cybercab. Tesla's Cybercab FAQ lists only a form for commercial purchase inquiries, and Cybercab rides run on Tesla's own Robotaxi service in limited areas of Austin, Texas. This article is for people planning ahead.

Taxis have always been regulated: medallions, permits, insurance and trip reporting. Driverless taxis add a layer. This overview covers three places with published rules or proposals. It is general information, not legal advice; check the current text before relying on it.

New York City: medallions and a licensed driver

The NYC Taxi and Limousine Commission's taxicab owner rules (Chapter 58) require that taxicabs operating for hire carry a valid medallion and be driven by a person with a valid TLC driver license, and that owners keep required insurance. NYC DOT runs a separate testing permit program for autonomous vehicles and says for-hire AV use must also comply with TLC rules.

A City Council bill, Int 0094-2026, would require the TLC to create a license for autonomous taxis, issued to medallion owners, with rules on safety, insurance, vehicle standards and reporting of each trip's pickup, drop-off, mileage and fare. It is a proposal, not law. A related state bill, A00793, is also pending.

California: DMV and CPUC

The California DMV issues three kinds of autonomous vehicle permits: testing with a safety driver, driverless testing, and deployment. To carry members of the public for fares, the CPUC's Autonomous Vehicle Programs require a DMV deployment permit, Transportation Charter Party authority, and for driverless service a Passenger Safety Plan. The Phase I deployment programs allow fares; the pilot programs don't.

Texas: TxDMV authorization

Under SB 2807, companies operating automated vehicles commercially in Texas must hold an authorization from the Texas Department of Motor Vehicles, enforceable since May 28, 2026, with certifications on equipment, registration and insurance.

Why the records overlap with taxes

Regulators ask for trip data for their own reasons, but the same data supports tax records. IRS Publication 463 asks for each business trip's miles, date, destination and purpose, and IRS Topic 510 bars the standard mileage rate for five or more cars operated at the same time. A per-trip log of pickup, drop-off and miles serves both.

Questions for an attorney and tax preparer

  • Which permits would be held by me, and which by the network operator?
  • What trip data do regulators require me to keep, and for how long?
  • How would medallion or permit costs be treated for tax purposes?

For the cars you drive for work today, CyberDeduct builds a mileage log around IRS Pub 463 from your Tesla's own trip and odometer data (Model S, 3, X, Y and Cybertruck). See how the log is built or see plans.
